RIGHT OF WITHDRAWAL

If you are a consumer, you have the right to withdraw from your purchase within 14 days without giving any reason.

The withdrawal period is 14 days from the day on which you, or a third party designated by you other than the carrier, receives the artwork. If several artworks from one order are delivered separately, the withdrawal period begins on the day on which the last artwork is received.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract by means of a clear statement.

You can exercise your right of withdrawal electronically using the “Returns & Cancellations” function available in the shop.

You may also use the model withdrawal form provided below, although this is not mandatory.

To meet the withdrawal deadline, it is sufficient that you submit your withdrawal before the 14-day withdrawal period has expired.

When the electronic withdrawal function is used, you will receive an electronic confirmation of your withdrawal without undue delay.

RETURN OF THE ARTWORK

After notifying us of your withdrawal, the artwork must be returned without undue delay and no later than 14 days from the day on which you informed us of your withdrawal.

The customer bears the direct cost of returning the artwork.

For artworks that can be returned by standard parcel service, the return shipping costs depend on the carrier, destination and dimensions of the shipment.

For large-format artworks that, due to their size or nature, cannot normally be returned by standard parcel service, specialised return transport may be required. The direct cost of such return transport is estimated at a maximum of approximately €300.

The artwork must be packaged carefully and securely in order to prevent damage during transport. Where available, we recommend using the original packaging. Use of the original packaging is not a condition for exercising the statutory right of withdrawal.

We strongly recommend using an insured and trackable shipping or specialised art transport service for all returns.

REFUNDS

If you withdraw from the contract, we will refund all payments received from you, including the cost of the least expensive standard delivery option offered for the original purchase.

Additional costs resulting from your choice of a more expensive delivery method than the least expensive standard delivery offered are not refundable.

Refunds will be made using the same payment method used for the original transaction unless expressly agreed otherwise.

We may withhold the refund until we have received the artwork back or until you have provided proof that the artwork has been returned, whichever occurs first.

You are only responsible for any loss in value of the artwork resulting from handling beyond what is necessary to establish its nature, characteristics and condition.

COMMISSIONED AND PERSONALISED ARTWORKS

The statutory right of withdrawal does not apply to artworks that are not prefabricated and are created on the basis of an individual selection or specification by the customer, or that are clearly tailored to the customer’s personal requirements.

This may apply in particular to commissioned artworks created specifically according to individually agreed dimensions, colours, composition, materials or other substantial customer-specific requirements.

Where the statutory right of withdrawal is excluded for a commissioned artwork, this will be clearly communicated to the customer before the order is placed.

An artwork is not automatically excluded from the right of withdrawal simply because it is produced after an order is placed. The exclusion applies only where the artwork meets the legal requirements for individually made or personalised goods.

For standard artworks, statutory consumer cancellation and withdrawal rights remain unaffected.

For commissioned or personalised artworks for which the statutory right of withdrawal does not apply, cancellation may no longer be possible once production has begun.

DAMAGED OR INCORRECT ARTWORKS

Please inspect the artwork upon delivery.

If an artwork arrives damaged or if you receive an incorrect artwork, please contact us as soon as possible at contact@nickjakho.com and include your order number as well as photographs of the artwork and its packaging.

This does not affect your statutory rights in relation to defective, damaged or incorrectly delivered goods.

BUSINESS CUSTOMERS

The statutory consumer right of withdrawal described above applies to consumers.

It does not apply to customers purchasing an artwork predominantly for purposes attributable to their commercial or independent professional activity.
